Product Liability

Products we have defended include aircraft, aviation equipment, aircraft engines, helicopters, automobiles, automotive parts, seat belts, boats, marine products, marine outboard motors, chain saws, household appliances including ovens and dishwashers, hand-held power tools including power saws, fishing equipment, drugs, pharmaceutical products, medical devices and equipment, surgical supplies, tires, motor homes, recreational vehicles, water heaters, paper making machinery, wire rope and other steel products, and heavy machinery and engines. We also have represented manufacturers and distributors of chemicals and other products in toxic tort cases and class actions. Our experience includes representation of testing laboratories and other service-related suppliers to manufacturers of a variety of products.

Our products liability group has handled numerous cases in both state and federal courts. Some of our lawyers successfully represented Kumho Tire Company before the trial court, the Eleventh Circuit Court of Appeals and the United States Supreme Court in the case in which the Supreme Court made its landmark decision clarifying that the trial court's gatekeeping duty under Federal Rule of Evidence 702, explaining it applies to all experts and not just scientific experts (Kumho Tire Co. v. Carmichael, 119 S. Ct. 1167 (1999)). We have also filed amicus briefs on behalf of the Alabama Defense Lawyers' Association in product liability cases pending in the Alabama Supreme Court.
